Property Settlement - Homemaker Contributions

In the four step process of property settlement, assessing the contributions of parties is an important requirement. The court will recognise homemaker contributions alongside financial and other non-financial contributions to the former relationship.

The court’s recognition of domestic contributions is a significant balancing factor. It enables parties who may have been unable to add financially to the former marriage or de facto relationship to have their contributions in the family home taking into account.

The court will typically have regard to two central factors:

  • Were the domestic duties at hand capable of being considered full-time or part-time responsibilities?
  • Was any housekeeping assistance utilised?
